VARIETY CARS Full Terms & Conditions

These Terms & Conditions ("Terms") outline the rules and conditions governing the purchase of vehicles and associated services from Variety Cars. By making a purchase or using our services, you agree to these Terms. We may update these Terms periodically as described in Condition 14, with the latest version always available on our website.

1. Information About Us
1.1 Who We Are: We are Variety Cars, a registered company in England and Wales Company number 08190384, located at Three Corners Garage, Ploughley Road, Ambrosden, OX25 2RH. Our VAT registration number is [176879440].

2. How the Contract is Formed Between You and Us
2.1 Home Delivery Orders: Any home delivery reservations are subject to our Home Delivery Terms of Reservation (“Reservation Terms”). These Terms are not part of our main Contract unless specifically stated.
2.2 Order Confirmation: When you arrange a home delivery and submit an offer to purchase a vehicle via our Site or over the phone, you are placing an “Order” with us, subject to these Terms.
2.3 Contract Formation: A legally binding agreement is established when:
We send you an Order Confirmation;
Payment has been made in full; or
We begin processing your order—whichever occurs first.
2.4 Acceptance of Orders: We reserve the right to decline your order for any reason, and in such cases, we will not be liable to you.
2.5 Non-Availability: If the vehicle you ordered becomes unavailable, faulty, or does not meet specific requirements, we will notify you and refund any payments already made.

3. Price of Vehicle and Additional Charges
3.1 Pricing Transparency: The price of the vehicle, including any applicable fees, will be confirmed in your Order Confirmation.
3.2 Additional Fees: Certain items or services may incur extra fees, such as:
Vehicle tax.
Extended warranties (optional)
Admin fees for processing documents
3.3 Incorrect Pricing: We strive to ensure pricing accuracy but reserve the right to correct any errors. If we discover an incorrect price, we will notify you and offer the correct price for confirmation. If you choose not to proceed, we will refund any payments made.

4. Payment & Delivery
4.1 Payment Due Date: Full payment is required before we confirm a delivery date. If payment is not made by the deadline, we may charge a re-delivery fee and additional costs for storage or insurance.
4.2 Delivery Requirements: You must present a valid UK ID at the time of delivery. Failure to provide this may delay delivery or result in a re-delivery fee.
4.3 Rescheduling: If you need to reschedule delivery, please provide at least 24 hours' notice. Late rescheduling may incur a re-delivery fee.

5. Cancellation & Returns
5.1 Pre-Delivery Cancellation: You may cancel your order before delivery, but refunds will be subject to applicable admin fees and mileage deductions (£1 per mile over 20 miles of usage).
5.2 Post-Delivery Cancellation: You have the right to cancel within 14 days of delivery. Refunds may be subject to deductions for mileage usage and other related costs.
5.3 Return of Vehicle: If you reject a faulty vehicle, you must return it within 48 hours. We may require a deposit of £250 for any missing V5c documents, refunded upon receipt.

6. Warranty Coverage
6.1 Standard Warranty: All vehicles come with a 3-month, 1,500-mile warranty covering engine and gearbox (parts and labour).
6.2 Extended Warranties: Available upon request, providing coverage between 6 to 24 months. These require repairs to be performed at VAT-registered garages.
6.3 Exclusions: Our warranty excludes wear-and-tear items, diagnostics, and transport-related costs.

7. Part-Exchange Policy
7.1 Part-Exchange Requirements: You must notify us of any part-exchange vehicles before placing your order. All part-exchange vehicles must be available for inspection at the time of delivery.
7.2 Valuation & Inspection: Part-exchange valuations remain provisional until verified by our team upon inspection.
7.3 Rejected Vehicles: If we reject a part-exchange vehicle, you will have the option to pay the difference or cancel, subject to applicable fees.
7.4 Cancellation: Variety cars have rights to retain the part-exchange vehicle if the agreement is cancelled.

8. The Vehicle
8.1 Vehicle History: We primarily deal with privately owned vehicles. While we provide as much information as possible, we do not guarantee a full service history for every vehicle.
8.2 Vehicle Images: Images on our site represent the vehicle as accurately as possible, but minor reflections or conditions may appear differently.
8.3 Specifications: Vehicle specifications are provided by manufacturers, and we do not guarantee their accuracy.
8.4 Tax and MOT: We cannot guarantee tax or MOT information’s accuracy and recommend verifying this information before making a purchase.

9. Your Obligations
9.1 Providing Information: You agree to provide necessary information to fulfil our obligations under the Contract.
9.2 Driving Licence: You must hold a valid UK ID card to place an order.
9.3 Insurance & Tax: From the point of ownership transfer, you are responsible for maintaining insurance, vehicle tax, and ensuring the vehicle is roadworthy.

10. Our Liability to You
10.1 Limit of Liability: We are only responsible for foreseeable loss or damage resulting from our breach of these Terms or negligence. We are not liable for unforeseeable losses.
10.2 Consumer & Business Liability: If purchasing as a consumer, the vehicle is for domestic use only. If purchasing as a business, we are not liable for loss of profit or business-related losses.
10.3 Exclusions: We do not exclude liability for death or personal injury caused by negligence, fraud, or breaches of your legal rights.

11. Faulty Vehicles
11.1 Consumer Rights: You have legal rights regarding faulty vehicles, and these are not affected by our warranty or return policy.
11.2 Returning Faulty Vehicles: Contact us within 48 hours and return the vehicle (with V5c, keys, and extras) for a refund or replacement.

12. Dispute Resolution
12.1 Customer Support: For complaints, contact our Customer Care team at contact@varietycars.co.uk.
12.2 ADR: If unresolved, we may refer disputes to an independent body for alternative dispute resolution.

13. Events Outside Our Control
13.1 Non-Performance: We are not liable for delays or non-performance due to events beyond our reasonable control (e.g., weather, strikes).
13.2 New Collection Date: If delivery is delayed, we will arrange a new collection date once the event has passed.

14. Our Right to Vary These Terms
14.1 Amendments: We may update these Terms at any time. The Terms in force at the time of your order will apply.
14.2 Notice of Changes: If we revise these Terms, we will notify you of any material changes and offer cancellation if you are not satisfied.

15. Other Important Terms
15.1 Transfer of Rights: We may transfer our rights under the Contract, but this does not affect your rights.
15.2 Language: These Terms and any related Contracts will be governed by English law and language.
15.3 Governing Law: Any disputes will be subject to the non-exclusive jurisdiction of English courts.
